FAMILY AND MARRIAGE BASED RESIDENCY

This immigration benefit allows U.S. Citizens and permanent residents to file a petition that will lead to the issuance of permanent residency to their immediate family members such as parents, children, brothers and sisters.

CITIZENSHIP-NATURALIZATION

This process allows an individual who was not born in the United States to become a citizen of the United States. Being of citizen of the United States giver you the right to vote, obtain an American Passport, obtain governmental jobs, and also importantly the ability to petition for an immediate relative through a much quicker process. Generally, to be eligible for citizenship, the applicant must have been a lawful permanent resident for five years (or three years for spouses of United States Citizens); the applicant must be at least 18 years old, be a person of good moral character, be able to speak, read and write English, pass a test on history and government of the United States and be physically present in the United States for at least half of the requisite time.

ALIEN FIANCÉ-K1 VISA

The K1 fiancé visa is issued to the fiancé of a U.S. citizen in order to enter the United States and marry the fiancé. Once the fiancé enters the United States, he or she must marry the United States citizen within 90 days. After the marriage, the fiancé can then file an application to adjust permanent residency. There are various documents that have to be shown in order for the fiancé petition and visa to be approved and granted.

TEMPORARY PROTECTED STATUS

Temporary Protected Status or TPS is temporary immigration status that allows individuals from certain countries that are facing extraordinary events like famine, civil war, and some other catastrophic events to remain in the United States. Congress has established a procedure to provide TPS to aliens that are in the United States. To view the list of countries that have been designated for TPS. CANCELLATION OF REMOVAL

Cancellation of Removal is a form of relief from deportation and nonpermanent residents. To be eligible for cancellation of removal, the nonpermanent resident alien must have lived continuously in the United States for at least ten years, be a person of good moral character and demonstrate to the Immigration Judge that his or her removal will subject his or her immediate family member who is a U.S. citizen or legal permanent resident to a severe and unusual hardship. For permanent residents the period for continuous presence in the United States is seven years.

ASYLUM

Asylum can be granted to people who are arriving in the United States or are already in the United States. The asylum application (form I-589 and other supporting documentation) must be filed within one year of last entry to the United States. An exception to the one-year filing deadline can be granted if the asylum applicant can show that there are changed circumstances or extraordinary circumstances that are directly related to the failure to meet the one-year filing deadline. Even if the applicant demonstrates the existence of the charged or extraordinary circumstance, he or she must still submit the asylum application within a reasonable time.
